I will be a witness for the prosecution in an attempted convenience store robbery where i work. I have a mental health history. Will this come out in court? Or am I protected by HIPPA?
Please guess even if you don't know the answer. HIPPA, as far as i know protects the confidentiality of medical records. However, people who are convicted of crimes aren't protected. However, will i as a witness be protected? I have an extensive mental health history that if it were to come out it could damage my reputation at the convenience store...my coworkers will be in court too!!!I'll be called to court as a witness in a robbery, but i'm mentally ill....will they find out?
Pretty unlikely. Testimony will be focused on what you saw, who you saw, what they said, what you said....basically it will be about one particular incident. I know on Law %26amp; Order and stuff you always see them destroy the witness' credibility in some dramatic sweeping gesture, but that's TV, it's like that for entertainment purposes. In real life, and esp for a relatively routine case and charge like this one, I would bet you money that the defendant's attorney didn't do any digging into your personal background, you are probably a v minor player in all this, and what you saw/did/heard, etc (whatever it is that has brought you in to testify) is all either side is concerned about when it comes to you.I'll be called to court as a witness in a robbery, but i'm mentally ill....will they find out?
if it isn't relative to your testimony, it may not come up.
As long as you are competent to give testimony, but; I would tell the prosecutor, so he can be aware of this event, just in case it was brought up.
